I Can’t Believe It’s Not Butter! Spray

September 2017: After the Jones appeal was dismissed, the parties agreed to continue the stay in this case pending a U.S. Supreme Court decision in a related case, Briseno v. ConAgra.

April 2015: A federal judge granted plaintiffs’ motion to stay pending the Ninth Circuit Court of Appeals’ decision in a related case, Jones v. ConAgra Foods.

January 2014: One claim in a class-action lawsuit originally filed against Unilever in 2013 survived a motion to dismiss. The claim moving forward alleges that the company labels I Can’t Believe It’s Not Butter! Spray as fat free without adequately disclosing it actually contains trace amounts of fat. A federal judge dismissed the allegations that the company’s serving size and nutrient content labels are unlawful and misleading.
