Sam’s Club Freshness Guarantee

July 2018: A federal judge granted final approval of a settlement agreement in which class members who file valid claims will receive a $10 gift card to be used at Sam’s Club or Walmart. For more information, go to https://www.samsclubfreshnesssettlement.com/.

2014: A class-action lawsuit was filed against Sam’s Club for allegedly failing to honor its “200% guarantee” on fresh meat, seafood, bakery, and produce items. Specifically, the complaint (which was later amended in 2015) alleges that the store promises to provide consumers who return such products with either a refund of the purchase price plus a replacement product or a refund that is double the purchase price when, according to the complaint, the named plaintiff returned products and never received a refund that was more than the purchase price or a replacement product. (Fejzulai et al v. Sam’s West, Inc. et al, Case No. 14-cv-3601 D. SC.)
