In November 2020, a class-action lawsuit was filed against Target for, among other things, allegedly falsely marketing Up & Up Brand Toddler Next Stage milk drink powder as “nutritionally appropriate” for children older than 12 months when, according to plaintiffs, the product contains less protein and more calories, sugars, and carbohydrates than is recommended for toddlers. (Gordon et al v. Target Corp., Case No. 20-cv-9589, S.D.N.Y.)
