February 2019: A federal judge preliminarily approved a proposed settlement agreement. According to its terms, the company agreed, for a period of two years, to remove the phrase “No Artificial Flavors” from marketing materials and packaging for SweeTARTS and to identify when dl-malic acid is an ingredient in SweeTARTS products. The settlement does not provide class members with monetary relief. A final fairness hearing is scheduled for May 31, 2019.

April 2018: A class-action lawsuit was filed against Nestle USA for allegedly falsely advertising SweeTARTS candies as natural and containing no artificial flavors when, according to plaintiffs, they contain synthetic, chemical, and artificial flavoring ingredients. (Littlejohn v. Nestle USA, Inc., Case No. 18-cv-658, S. D. CA.)
