March 2019: A federal judge granted class certification for the Florida and New York classes but denied class certification for North Carolina and Multistate classes.
February 2017: This case was consolidated with two similar cases (Greene v. Gerber and Hasemann v. Gerber) for discovery and pretrial purposes.
January 2017: Another class-action lawsuit was filed against Gerber for allegedly deceptively marketing Good Start, a line of infant formula made with whey-protein concentrate. Specifically, the complaint alleges that Gerber markets the formula as the first and only formula that reduces the risk of infants developing allergies and as endorsed by the FDA for this purpose when such claims are false. (Manemeit et al v. Gerber Products Co. d/b/a Nestle Nutrition, Nestle Infant Nutrition, and Nestle Nutrition North America, Case No. 17-cv-93, E. D. NY.)
