Allegations: Falsely marketing that dietary supplements promote “heart health” and provide various heart health benefits without scientific evidence to support such claims
In June 2017, a class-action lawsuit was filed against NBTY, Inc., Nature’s Bounty, Inc., and Rexall Sundown, Inc. for allegedly deceptively labeling Nature’s Bounty Ginkgo Biloba and Sundown Naturals Ginkgo Biloba dietary supplements as providing a variety of health benefits – including “Support[ing] Healthy Brain Function and Circulation,” “help[ing] support memory, especially occasional mild memory problems associated with aging,” and “Help[ing] Support Mental Alertness” – when, according to the complaint, scientific evidence shows that the supplements are not effective and do not improve cognitive health or increase memory and healthy function of brains. (Petkevicius et al v. NBTY, Inc., Nature’s Bounty, Inc., and Rexall Sundown, Inc., Case No. 17-cv-1152, S. D. CA.)
