March 2022: Plaintiff filed a Notice of Appeal regarding the February 2022 dismissal.

February 2022: The district court adopted the magistrate judge’s recommendation and granted Kroger’s motion to dismiss.

September 2021: A magistrate judge recommended that the district court grant Kroger’s motion to dismiss.

August 2020: A a class-action lawsuit was filed against The Kroger Company for allegedly misleadingly marketing Kroger’s Just Fruit Spreadable Fruit products as containing only the fruit identified on the front label when, according to plaintiffs, the ingredients list on the back reveals that the product contains more “fruit syrup” than fruit. Plaintiffs also claim that the product contains other sweeteners, added sugars and additives. (Vitort et al v The Kroger Company et al, Case No. 20-cv-1317, D. Ore.)
