A class-action lawsuit was filed against The Kroger Co. for allegedly deceptively labeling Kroger 100% Apple Juice, Kroger 100% Natural Apple Juice, and Simple Truth Organic 100% Apple Juice as having “No Sugar Added” when apple juice does not usually contain added sugar. (According to the complaint, the FDA has stated that the label “No Sugar Added” is not appropriate to describe foods that do not normally contain added sugars.) This lawsuit was originally filed in state court in February 2017 and transferred to federal court in March 2017. (Perez et al v. The Kroger Co., Case No. 17-cv-2448, C. D. CA.)
