In July 2020, a class-action lawsuit was filed against The Kroger Co. for allegedly misleadingly marketing Kroger® Infants’ Pain & Fever Acetaminophen and Kroger® Children’s Pain & Fever Acetaminophen as different products and charging more for the infants’ product when, according to plaintiffs, both products contains the same amount of the active ingredient acetaminophen. (Hartwich et al v. The Kroger Co. and Ralphs Grocery Company, Case No. 20-cv-1253, C.D. Cal.)
