June 2017: Plaintiffs in a false advertising class-action lawsuit against The Hain Celestial Group and Jason Natural Products moved for final approval of a settlement agreement reached between the parties. The complaint, which was originally filed in August 2016 and amended in November 2016, alleges that the companies market products – including Long & Strong Jojoba Pure Natural Shampoo, Volumizing Lavender Shampoo, Normalizing Tea Tree Treatment Shampoo, Dandruff Relief 2 in 1 Treatment Shampoo & Conditioner, and Smoothing Coconut Body Wash – as being SLS-free when, according to plaintiffs, they contain substantial amounts of SLS (sodium lauryl sulfate.)
According to the proposed settlement terms, class members with proof of purchase may receive $8 for each product purchased (for a maximum recovery of $40) while class members without proof may receive $2 for each product purchased (for a maximum recovery of $10). In addition, the companies have revised packaging to remove SLS-free claims or have changed the formulation of products and, as part of the settlement agreement, agreed not to reintroduce the SLS-free claim unless products’ formulation have changed.
