April 2018: A federal judge dismissed this case When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. finding that the challenged statements and images are not misrepresentations and would not mislead reasonable consumers. June 2017:class-action lawsuit was filed against Sensible Portions for allegedly misleadingly marketing the vegetable content and nutritional and health qualities of its Garden Veggie Straws. Specifically, the company markets the straws as containing significant amounts of actual vegetables (such as “garden grown potatoes [and] ripe vegetables”) when, according to plaintiffs, the straws do not contain any of the vegetables. (Solak et al v. The Hain Celestial Group, Inc. d/b/a Sensible Portions, Case No. 17-cv-704, N.D.N.Y.)
