Telebrands “Everyday Savings” Program
Allegations: Failing to tell customers who purchased products that they would be enrolled in its “Everyday Savings” program
In August 2017, a state court judge preliminarily approved a settlement resolving the claims in a false advertising class-action lawsuit against Telebrands. The October 2014 complaint alleges that the company misleadingly advertised that consumers who purchased a product – including Crazy Critters, Windshield Wonder, and Heeltastic – would receive a bonus product for free when, according to plaintiffs, consumers were charged for the product and required to pay shipping, processing, and handling fees. According to the settlement terms, class members who submit timely claims may each receive a $5 award. A final fairness hearing is scheduled for January 25, 2018.
