December 2013: Two class-action lawsuits were filed against USPLabs regarding its advertising of the OxyElite Pro brand of energy and weight loss dietary supplements.

In one case, which was filed in Florida, the complaint alleges that the supplements are marketed as safely providing weight loss, energy, and mental focus when they actually cause severe adverse health effects like liver failure. In addition, the plaintiffs claim that the company markets the supplement as safe when, according to plaintiffs, it actually contains aegeline, an ingredient associated with causing serious adverse health consequences. (Mazzeo et al v. USPLabs, LLC., Case No. 13-cv-62639, S. D. FL.).

In the other case, which was filed in California, the plaintiffs claim that USPLabs and GNC misleadingly market supplements – including OxyElite Pro and Jack3d – as safe and effective when, according to plaintiffs, the companies do not have support for such claims and the supplements actually contain dangerous ingredients, such as dimethylamylamine (DMAA) or aegeline. (Campos et al v. USPLabs, LLC and GNC Corp., Case No. 13-cv-02891, S. D. CA.).
