February 2019: The stay of the “natural” and “non-GMO” claims was lifted.
March 2018: Both the “natural” and “non-GMO” claims were stayed until August 15, 2018. The natural claims were stayed pending the FDA’s determination of the proper use of the term “natural” and the non-GMO claims were stayed pending the USDA’s work establishing a national GMO standard.
October 2016: An Amended Consolidated Class Action Complaint was filed. The complaint alleges that the company markets snack foods – including various flavors of Fruit & Nut bars, Nuts & Spices bars, and Healthy Grains Clusters – as “All Natural” and “Non GMO” when, in reality, the snacks contain heavily processed and genetically modified ingredients. August 2015: Multiple similar false advertising class-action lawsuits filed against KIND, LLC were transferred to a New York court to be heard together. The actions allege that the company deceptively markets snack bars as “all natural,” “healthy,” a “good source of fiber,” and containing “no trans fat” when, in reality, they have little nutritional value, high levels of saturated fat, and non-natural ingredients.
