April 2015: A class-action lawsuit was filed against Kind LLC for allegedly misbranding KIND bars and snack products. According to the complaint, at least four products (Almond & Apricot, Almond & Coconut, Peanut Butter Dark Chocolate + Protein, and Dark Chocolate Cherry Cashew + Antioxidants) are misbranded in violation of the Federal Food, Drug, and Cosmetic Act. More specifically, the complaint alleges that the company:

  • Misleadingly uses terms – including “healthy,” “plus,” and “antioxidant” – without meeting the requirements to make such claims;
  • Misleadingly claims products are a “Good Source of Fiber” without disclosing that the food is not low in total fat, as required by federal regulations;
  • Misleadingly claims that products contain “no trans fat” without including the levels of monounsaturated fatty acids and polyunsaturated fatty acids in the nutrition information, as required by federal regulations;
  • Misleadingly using “+ protein” and “plus 7 g protein” without also including the percent daily value for protein, as required by federal regulations; and
  • Fails to accurately state the company’s place of business on the product labels, in violation of federal regulations.

In addition, plaintiffs claim that the company falsely labels the products as “All Natural” and “Non GMO” when the products actually contain genetically modified and non-natural, highly processed ingredients. (Bustamante et al v. Kind LLC, Case No. 15-cv-891, S. D. CA.)
