Kind Fruit Bars and Other Snacks

In September 2018, a class-action lawsuit was filed against Kind LLC for allegedly misleadingly marketing Kind fruit bars and snacks – including Mango Apple Chia fruit bars and 5 Cherries ½ Apple snacks – as containing fresh whole fruits when, according to the complaint, the products contain imported ingredients and it is likely that the imported fruits were processed before being transported to the United States. In addition, the complaint claims that the marketing represents that the bars and snacks contain only the ingredients in the product name when, according to plaintiffs, there are other ingredients – such as sugars, water, and ascorbic acid – in the products. Plaintiffs also claim that the company markets several of the products as having No Added Sugar when, according to the complaint, they contain added sugars. (Song et al v.
