November 2016: After being consolidated with Stoltz v. Chobani LLC, this action was voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled.. The reasons for the dismissal were not disclosed. (Case No. 15-cv-4698, E. D. NY.)
August 2014: A class-action lawsuit was filed against Chobani for allegedly misleadingly labeling several varieties of its Greek Yogurt, including Fruit on the Bottom, Blended, Simply 100™, Flip™, and Kids yogurts. (The case has since been transferred from state court to federal court.) Specifically, the complaint alleges that the company misleadingly represents that its yogurts contain “evaporated cane juice” when they actually contain sugar. Plaintiffs also claim that the yogurts’ packaging misleadingly displays “0%” without indicating or explaining what the 0% represents. In addition, the complaint alleges that the company represents that the yogurts are healthy and nutritious when, in reality, they are “comparable to eating junk food.” (Clay et al v. Chobani LLC, Safeway Inc., The Vons Companies, Inc., and Does 1-50, Case No. 14-cv-02258, S. D. CA.).
