August 2016: The Second Circuit Court of Appeals vacated the District Court’s decision to dismiss the case and remanded the case for further proceedings. (Nicosia et al v. Amazon.com, Inc., Case No. 15-423, 2nd Cir.)
February 2015: A federal judge dismissed this lawsuit finding, among other things, that the plaintiff waived his right to bring a class-action lawsuit against Amazon, and agreed to have an A person chosen to settle a dispute or differences between parties. settle any individual’s disputes.

July 2014: A class-action lawsuit was filed against Amazon.com, Inc. According to the complaint, Amazon failed to warn consumers that certain weight-loss products – including “1 Day Diet” – contain “Sibutramine,” a stimulant which the FDA found to cause serious risks of cardiovascular events and strokes. (Nicosia et. al v. Amazon.com, Inc., Case No. 14-cv-04513, E.D. NY.).
