The named plaintiffs’ claims were dismissed When a complaint is dismissed with prejudice, it cannot be refiled. and the class members’ claims were dismissed When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.. The reasons for the dismissal have not yet been disclosed.
August 2014: A federal court suspended a class-action lawsuit filed against Trader Joe’s in 2013 pending the FDA’s determination of when the term “evaporated cane juice” may appropriately be used. The complaint that is now on hold alleges that the company:
