Various MusclePharm Supplements

September 2016: A federal judge granted MusclePharm’s motion to dismiss finding, among other things, that plaintiffs did not have standing, failed to state a claim, and did not satisfy the heightened pleading requirement for fraud-based claims.

December 2015: A class-action lawsuit was filed against MusclePharm Corp. for allegedly misleadingly marketing various supplements, including MusclePharm Arnold Schwarzenegger Series Iron Pump Pre-Workout Powder, MusclePharm Arnold Schwarzenegger Series Iron Cre3 Creatine Powder, MusclePharm Creatine Supplement, MusclePharm Arnold Schwarzenegger Series Iron Dream Nighttime Support Powder, and MusclePharm Assault Pre-Workout Powder. According to the complaint, the company markets supplements containing specific “newly formulated, novel” ingredients (i.e., ingredients that chemically fuse an amino or organic acid with a nitrate) as safe when, in reality, the safety of such ingredients has not been established. In addition, the complaint alleges that the company markets supplements as providing various benefits – including increasing strength, endurance, muscle mass, and overall performance – without scientific evidence to support such claims.
