In December 2015, a class-action lawsuit was filed against Spark Energy (a supplier of electricity and natural gas) for allegedly engaging in a deceptive bait-and-switch scheme. According to the complaint, the company promises customers who switch from their local utilities to Spark will save on their monthly energy bill and pay competitive variable rates based on market rates when, in reality, the company routinely increases its rates after customers switch and, as a result, customers pay up to four times more for natural gas than they would have with another supplier. (Melville et al v. Spark Energy, Inc. and Spark Energy Gas, LP, Case No. 15-cv-8706, D. NJ.)
