January 2017: A federal judge dismissed this case When a complaint is dismissed with prejudice, it cannot be refiled.. Claims against Charoen Pokphand Foods and C.P. Food Products (collectively the “CP defendants”) were dismissed for lack of standing because plaintiffs did not allege that they purchased any products produced or marketed by the CP defendants. Claims against Costco were dismissed because plaintiffs failed to allege that Costco had a duty to disclose information about labor abuses and plaintiffs did not sufficiently allege false advertising, among other things.

February 2016: Plaintiffs filed an amended complaint making similar allegations.

January 2016: A federal judge granted the companies’ motion to dismiss finding that the named plaintiff did not have standing (i.e., a proper basis) to sue. The dismissal was When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled..

August 2015: A class-action lawsuit was filed against Costco and C.P. Food Products for, among other things, allegedly failing to disclose important information about its shrimp (i.e., that the shrimp was obtained from a supply chain that depends on slavery, human trafficking, and other illegal labor abuses) and deceptively representing that the company does not allow slavery in its supply chain. (Sud et al v. Costco Wholesale Corp., Charoen Pokphand Foods, PLC, C.P. Food Products, Inc., Case No. 15-cv-3783, N. D. CA.)
