May 2016: This action was dismissed When a complaint is dismissed with prejudice, it cannot be refiled. because the named plaintiff agreed to return the purchased sweaters and J. Crew agreed to mail the named plaintiff a check for $103.50.
March 2016: A class-action lawsuit was filed against J. Crew for allegedly misleadingly advertising discounts on its J. Crew Factory store website. According to the complaint, the website misleadingly advertises the amount of discounts (e.g., 30% off the “valued at” price) when, according to plaintiffs, consumers do not get the advertised discount because products are never sold at the “valued at” price. In addition, the complaint alleges that the website represents that discounts are offered for a limited time (e.g., 24 hours or 5 days) when, in reality, the items are always sold at a “discounted” price because each sale is followed by another similar sale. (D’Aversa et al v. J. Crew Group, Inc. et al, Case No. 16-cv-1590, S. D. NY.)
