February 2020: This case was transferred from state court to federal court. (Case No. 20-cv-1436, N.D. Cal.)

January 2020: A class-action lawsuit was filed against Carter’s for allegedly misleadingly advertising that customers are getting a specific percentage discount off of a reference price when, according to the complaint, the reference price is inflated and merchandise is almost never sold at the reference price. Plaintiffs also allege that the retailer advertises “BUY 1, GET 1 Free” offers when, according to the complaint, the retailer doubles the price of one product in order to recover cost of the second free product. (Simon et al v. Carter’s, Inc., Case No. 20CV361777, California State Court – Santa Clara)
