In April 2019, a class-action lawsuit was filed against the baby and children’s clothing retailer Carter’s for allegedly sending customers an email advertisement misleadingly representing that the retailer was offering “50-70% OFF EVERYTHING” when, according to plaintiffs, hundreds of items were excluded from the sale and the discount was off of an inflated Manufacturer’s Suggested Retail Price (MSRP), which was higher than the market value and items were rarely, if ever, sold at the MSRP price.
