In May 2016, a class-action lawsuit was filed against Carter’s and OshKosh B’gosh for allegedly misleadingly advertising discounts on children’s apparel and accessories sold in retail and outlet stores. Specifically, the complaint claims that the stores made consumers believe items were “significantly discounted” by misleadingly comparing sale prices to “false” market prices that were “artificially inflated” and were never the original prices for the items. In addition, plaintiffs claim that the represented market prices were not the prevailing market prices within the three months immediately before the advertisement, as required by California law.
