September 2016: The appeal was voluntarily dismissed, the reasons for which have not been disclosed.

March 2016: A federal judge dismissed this lawsuit finding, among other things, that the allegedly false marketing claims are permitted under FDA regulations. The lawsuit was dismissed without leave to amend. To learn more about all of the reasons the lawsuit was dismissed, click here to read the court order. The named plaintiff filed a Notice of Appeal.

April 2015: A class-action lawsuit was filed against Nestle for, among other things, allegedly falsely marketing Coffee-Mate creamers as containing “0g Trans Fat” when, in reality, the creamers contain “dangerous levels of trans fat.” (Backus et al v. Nestle USA Inc., Case No. 15-cv-1963, N. D. CA.)
