Allegations: Misleadingly advertising discounts from artificially inflated reference prices
In June 2017, a class-action lawsuit was filed against New York & Company for allegedly misleadingly advertising discounts at its outlet stores by misleadingly comparing “discounted” prices to “OUR PRICE” prices (i.e., original prices) when, according to the complaint, the merchandise was never offered at the represented original prices, which are artificially inflated. (Hedrick et al v. New York & Company, Inc. and New York & Company Stores, Inc., Case No. 17-cv-1153, S. D. CA.)
