Allegations: Falsely advertising discounts off of artificially inflated reference prices
May 2019: Plaintiffs moved for preliminary approval of a proposed settlement agreement that would automatically provide class members with a voucher for $7.50 off of any purchase at New York & Company retail and outlet stores. In addition, class members who have proof of making $50 in qualifying purchases may receive a second voucher. Class members also have the option of filing a claim form to receive a voucher for 25% off of a purchase of up to $100 instead of the $7.50 voucher.
February 2019: A class-action lawsuit was filed against Retailwinds and New York & Company for allegedly deceptively advertising pricing discounts. Specifically, the complaint alleges that the retailer misleadingly compares discounts off of regular prices when, according to plaintiffs, the retailer never offers the merchandise for sale at the represented regular prices. (Rael et al v. RTW Retailwinds Inc., Case No. 201900003850, California State Court – San Diego)
