March 2018: The named plaintiffs filed a Notice of Appeal regarding the February 2018 decision to dismiss the case.
February 2018: A federal judge granted Coca-Cola’s motion to dismiss concluding that the complaint failed to sufficiently allege that Coca-Cola misrepresented that Diet Coke aids in weight loss and healthy weight management without lifestyle changes to exercise and nutrition.
October 2017: A false advertising class-action lawsuit was filed against Coca-Cola for allegedly misleadingly marketing Diet Coke as a drink that assists in weight loss and healthy weight management when, according to the complaint, the soda contains an artificial sweetener (aspartame), which, according to scientific evidence, leads to weight gain and increases the risk of metabolic disease, diabetes, and cardiovascular disease.
