March 2018: A federal judge dismissed this case concluding that reasonable consumers would not be misled by the You know when you buy a big bag of chips, and you’re all psyched for a feast, and then it turns out there are like, three chips in the bag? That bag is slack filled.ed packaging. The judge also found that plaintiffs did not have standing for injunctive relief claims and failed to adequately plead that the empty space was not functional.
April 2017: A class-action lawsuit was filed against Wise Foods for allegedly deceptively packaging bags of potato chips to make consumers believe they are getting more chips than they actually are. According to the complaint, the 7 oz. bag of Golden Original Potato Chips and the 6.75 oz. bag of Ridgies Sour Cream and Onion potato chips are 67% empty space. (Plaintiffs filed an amended complaint in June 2017.) (Alce v. Wise Foods, Inc., Case No. 17-cv-2402, S.D.N.Y.)
