February 2018: A federal judge granted preliminary approval of a settlement agreement. According to the terms, class members will receive a partial refund for the amount they paid while on a variable plan. Class members who were enrolled in a variable plan between January 2011 and January 2014 will receive a 15% refund and class members who were enrolled in a variable plan between January 2014 and February 2018 will receive a 2% refund. A final fairness hearing is scheduled for August 8, 2018.
August 2014: Another class-action lawsuit was filed against Ambit Energy for allegedly deceptively inducing customers to switch their energy supplier to Ambit Energy. Among other things, plaintiffs claim that the company promises customers who switch to Ambit Energy will save money when, in reality, these customers may pay “two to three times more” for their electricity. (Plaintiffs later filed an amended complaint.) (Silvis et al v. Ambit Energy, L.P. et al, Case No. 14-cv-05005, E.D. Penn.).
