July 2020: This case was transferred from state court to federal court. (Case No. 20-cv-1289, S.D. Cal.)

June 2020: A class-action lawsuit was filed against Booking Holdings for allegedly falsely advertising the price and availability of hotel rooms on the Agoda travel website and app. Specifically, plaintiffs claim that the company misleads consumers by:

  • Marketing that the rate of hotel rooms is discounted off of an “original price” when, according to the complaint, the represented “original price” is fake and a majority of hotel rooms are never, or almost never, rented at any price other than Agoda’s price;
  • Marketing that the discounted room rate is available for a limited time when, according to the complaint, the discounted rate is available for a longer period of time than represented; and
  • Marketing that there are a limited number of hotel rooms left when, according to the complaint, such claims are false.
