ACT Restoring Mouthwash

May 2015: A federal judge granted Chattem Inc.’s motion to dismiss finding that the claim was preempted by federal law.

February 2015: A false advertising class-action lawsuit was filed against Chattem Inc. in January 2015 (and transferred from state court to federal court in February 2015) alleging that the company falsely markets that ACT Restoring Mouthwash “REBUILDS tooth enamel” when, in reality, there is “overwhelming scientific knowledge that tooth enamel cannot be rebuilt.” (Wiltz et al v.
