December 2020: A federal judge dismissed the complaint When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled. concluding that plaintiffs failed to plausibly allege that reasonable consumers would expect vanilla to be the only flavoring ingredient in the product. Later in December, plaintiffs filed an amended complaint bringing similar allegations.
May 2020: A class-action lawsuit was filed against Westbrae Natural for allegedly falsely advertising that the flavoring ingredient in Westsoy Organic Unsweetened Vanilla Soymilk is vanilla when, according to plaintiffs, the ingredients list reveals that the product also contains “other natural flavors.” (Clark et al v. Westbrae Natural, Inc., Case No. 20-cv-3221, N.D. Cal.)
