Welch’s Fruit Snacks

June 2018: After the Atik case was dismissed, the Hall case was transferred back to a court in New Jersey. (Hall v. Welch Foods, Case No. 18-cv-105000, D.N.J.)

October 2017: This case was transferred from a New Jersey court to a New York court where a similar case, Atik v. Welch Foods Inc. et al (15-cv-5405, E.D.N.Y.), is pending. (Hall v. Welch Foods, Case No. 17-cv-5828, E.D.N.Y.)

June 2017: The lawsuit was transferred to federal court. (Hall et al v. Welch Foods, Inc. et al, Case No. 17-cv-3997, D.N.J.)

April 2017: A false advertising class-action lawsuit was filed against Welch Foods for allegedly deceptively marketing Welch’s Fruit Snacks as containing significant amounts of actual fruits by stating “Made With REAL Fruit,” and “Fruit is our 1st Ingredient!” when, according to the complaint, the fruit snacks contain only minimal amounts of fruit and two of the first three ingredients are added sweeteners. In addition, the complaint alleges that Welch Foods markets its Fruit Snacks as nutritious, healthful, and healthier than similar products when, according to plaintiffs, the snacks are no healthier than candy.
