Allegations: Products provide less than half of the protein advertised
September 2015: Three similar cases (including Rhinerson, Campbell, and Frei) were voluntarily dismissed When a complaint is dismissed with prejudice, it cannot be refiled.. The reasons have not been disclosed.
June 2015: Van’s International Foods moved to stay (i.e., suspend) the action in both the Frei action and the Rhinerson action pending a settlement of another similar lawsuit, Miloro et al v. Van’s International Foods. For more information about the Miloro case, click here.
April 2015: This lawsuit was transferred to the Northern District of California where a similar lawsuit, Rhinerson v. Van’s International Foods, Inc. (Case No. 13-cv-5923) is also pending. (Frei et al v. Van’s International Foods, Case No. 15-cv-1723, N. D. CA.)
January 2015: A class-action lawsuit was filed against Van’s International Foods, Inc. for allegedly falsely marketing products – including Van’s Totally Natural Organic Waffles, Van’s Totally Natural Power Grains Waffles, and Van’s Totally Natural Organic Blueberry Waffles – as “all natural” when they actually contain synthetic ingredients. (Frei et al v. Van’s International Foods, Inc., Case No. 15-cv-00209, D. CO.).
