December 2017: A federal judge granted preliminary approval of a proposed settlement agreement. According to its terms, class members may choose to get either a cash refund or a credit to apply toward future online purchases. Class members with proof of purchase may get either $10 in cash or a $14 credit for each product purchased and class members without proof of purchase may get a maximum of $5 in cash or a $7 credit. In addition, the company agreed to stop making unsubstantiated claims and any false or misleading statements that the copper or zinc in the products will relieve pain, accelerate muscle and joint recovery, and improve muscular power, strength, and endurance. A final fairness hearing is scheduled for April 1, 2018.
April 2015: A class-action lawsuit was filed against Tommie Copper Inc., the manufacturer of “copper-infused” athletic apparel, for allegedly misleadingly representing that its apparel will provide pain relief, skin, and health benefits – including providing relief from aches and pains and speeding recovery time – when, according to plaintiffs, such claims are not true. (Potzner et al v. Tommie Copper Inc., Case No. 15-cv-3183, S.D.N.Y.)
