Tommie Copper Athletic Compression Apparel and Accessories

December 2017: A federal judge preliminarily approved a settlement agreement that would resolve this consolidated class action, as well as another similar case, Herst v. Tommie Copper.

According to the settlement terms, class members may receive a cash award or choose to apply their award to a future purchase on the Tommie Copper website. Class members with proof of purchase may receive a $10 reimbursement for each product purchased while class members without proof of purchase are limited to a maximum of $5 total. Class members who choose to apply their cash award to a purchase will receive an enhancement, meaning that the amount applied to their purchase will be the total amount of their cash award plus 40% of that cash award. In addition, the company agreed not to use any unsubstantiated claims, false representations, and statements that the copper in products relieves pain, aids in injury management, speeds muscle and joint recovery, and improves muscle power, strength, and endurance in the advertising for Tommie Copper products.

A final fairness hearing is scheduled for May 1, 2018.

March 2016: A Consolidated Class Action Complaint making similar allegations was filed.

January 2016: This case was consolidated with another similar lawsuit, Potzner v. Tommie Copper.

July 2015:
A class-action lawsuit was filed against Tommie Copper Inc. for allegedly marketing that its “copper-infused” products provide pain relief and various health benefits – including reducing pain and inflammation from medical conditions such as arthritis and multiple sclerosis – when, according to plaintiffs, such claims are not true. (Lucero et al v. Tommie Copper Inc., Tommie Copper Holdings, Inc, Thomas Kallish and Montel Williams, Case No. 15-cv-6055, S.D.N.Y.)
