February 2020: A federal judge granted final approval of a settlement agreement that provides class members with a $6.25 cash award for up to four purchases per household. 2019: Plaintiffs filed an amended complaint similarly alleging that Spectracide® Weed and Grass Killer Concentrates do not make the number of gallons advertised on the product label. (Graves et al v. United Industries Corp., Case No. 17-cv-6983, C.D. Cal.)
2017: A class-action lawsuit was filed against United Industries Corporation for allegedly falsely advertising Spectracide® Weed and Grass Killer Concentrates. The complaint alleges that consumers who follow the instructions for “general weed control” do not make the amount of weed and grass killer represented on the product label. Specifically, the labels say that the 16 ounce container “Makes Up to 5 Gallons,” the 32 ounce container “Makes Up to 10 Gallons,” and the 64 ounce container “Makes Up to 20 gallons” when, according to plaintiffs, they make 3.3 gallons, 6.6 gallons, and 13.2 gallons, respectively. Plaintiffs also claim that the labels fail to disclose that the only way to get the amount on the labels is to follow the instructions for “newly emerged weeds.” (Arthur et al v.
