
CATrends: Deceptive Influencer Marketing
It’s a hot sponcon summer.
In July 2017, a class-action lawsuit was filed against Nine West for allegedly deceptively advertising pricing discounts at outlet stores. According to the complaint, the store deceptively compares a “SUGG. RETAIL” price to a fictitious “OUR PRICE” to make consumers believe they are getting merchandise at a steep discount when, according to plaintiffs, consumers are paying the regular price for merchandise. (Covell et al v. Nine West Holdings, Inc., Case No. 17-cv-1371, S. D. CA.)
