In May 2019, a class-action lawsuit was filed against Postmates (a food delivery app and website) for allegedly falsely advertising that its services deliver “Anything. Anytime. Anywhere.” when, according to plaintiffs, Postmates cannot make deliveries from certain restaurants because other delivery services have exclusive arrangements to make deliveries for them. In addition, plaintiffs claim that the delivery service represents that it charges a “Delivery Fee” without adequately disclosing that it also charges a “Service Fee.” (Feld et al v. Postmates, Inc., Case No. 19-cv-3899, S. D. NY.)
