In February 2020, a class-action lawsuit was filed against Burke & Herbert Bank & Trust Co. for allegedly misleadingly promising that it only charges overdraft or non-sufficient funds fees on transactions if an account does not have enough money to cover the transaction when, according to plaintiffs, the bank improperly charges such fees even when an account has enough money to cover the transaction. (Randall et al v. Burke & Herbert Bank & Trust Co., Case No. 20-cv-183, E.D. Va.)
