Nissan’s 2014 Infiniti Q50 InTouch

May 2017: The claims in this action were resolved as part of a settlement in another case, Rafafsky v. Nissan. According to the settlement terms, class members may receive a $500 voucher to use toward the purchase or lease of a new Infiniti vehicle, or a cash award in the amount of $30, plus an additional $55 if they affirm that they downloaded the Infiniti InTouch App before April 17, 2017. A final fairness hearing is scheduled for September 11, 2017.

October 2014: A class-action lawsuit was filed against Nissan for allegedly falsely advertising the 2014 Infiniti Q50’s InTouch feature. According to the complaint, the marketing materials for the 2014 Infiniti Q50 represent that consumers can access mobile phone apps, emails, and a calendar using the InTouch feature when, in reality, as of September 2014, consumers were unable to access the advertised apps and functions using InTouch. (Zingerman, D.D.S., P. C., d/b/a Niles Family Dental et al v. Nissan North America, Inc., Case No. 14-cv-07835, N. D. IL.).
