April 2016: A class-action lawsuit was filed against Mars, Inc. for allegedly deceptively packaging M&M’s® Mini products to make it appear as if consumers are buying more than they actually are. According to the plaintiffs, the products’ non-transparent containers have “excessive empty space,” in violation of federal and state laws and regulations. For example, 22% of the 1.08 oz. container is empty space and 14% of the 1.77 oz. container is empty space. (Godsonov et al v. Mars, Inc., Case No. 16-cv-1745, E. D. NY.)
