July 2016: The named plaintiff moved to voluntarily dismiss his claims When a complaint is dismissed with prejudice, it cannot be refiled.. After the store showed that the plaintiff never bought the products at issue and created “fraudulent bank statements to support his perjurious testimony,” the store opposed the motion to dismiss arguing, among other things, that the plaintiff is moving to dismiss this lawsuit in order to avoid a summary judgment ruling. A hearing regarding the motion for voluntary dismissal is scheduled for August 15, 2016.

July 2014: A class-action lawsuit was filed against Jos. A. Bank (a retailer of men’s suits, sportcoats, and dress pants) alleging that the company misleadingly offers sales, discounts, and free apparel promotions. Among other things, plaintiffs claim that the store deceptively offers sales and promotions to consumers who purchase “regular” priced items when, in reality, the store inflates the “regular” prices in order to deceive consumers into believing they are getting a good deal and these items are on “sale” all of the time. (Lucas et al v. Jos. A. Bank Clothiers, Inc., Case No. 14-cv-1631, S. D. CA.).
