A false advertising class-action lawsuit was filed against Jos. A. Bank Clothiers for allegedly falsely advertising regular prices, discounts, and free apparel. The complaint alleges that the store misrepresents the nature and amount of pricing discounts for its men’s suits, sports coats, and dress pants by offering specific dollar and percentage discounts from false, inflated “regular” prices. In addition, plaintiffs claim that the store misleadingly promotes that customers who buy one “regular” priced suit get one or more items free when, according to the complaint, the regular price is a “sham.” The complaint was originally filed in state court in January 2017 and transferred to federal court in May 2017.
