September 2015: The parties agreed to dismiss this action When a complaint is dismissed with prejudice, it cannot be refiled.. The reasons for the dismissal have not been disclosed.

January 2014: A class-action lawsuit was filed against Hammer Nutrition, Inc. for allegedly falsely marketing its products – including Appestat capsules and Perpetuem powder – as “all natural” when they actually contain synthetic ingredients. In addition, plaintiffs claim the company misleads consumers by failing to identify ingredients in product labels and making claims that Garcinia Cabogia (or hydroxycitric acid) is safe and effective as a weight loss nutrient when, in reality, it is not. (Harabedian et al v. Hammer Nutrition, LTD., Case No. 14-cv-00459, E. D. NY.).
