Specifically, the complaint alleges that the company falsely markets Equate Migraine as a “superior and more-potent drug for headache relief” when, according to the plaintiffs, both Equate Extra Strength Headache Relief and Equate Migraine Relief contain the same amount of the same ingredients. (Newsome et al v. Wal-Mart Stores, Inc., Case No. 13-cv-07714, S.D.N.Y.).
