July 2014: Plaintiffs filed an amended complaint against only one of the defendants, HSNi d/b/a Home Shopping Network, alleging that the knives are advertised as being manufactured in Germany when, according to plaintiffs, they are manufactured in China and that the quality of the knives is misrepresented.
June 2014: A federal judge granted the company’s motion to dismiss because the complaint did not explain how each one of the companies was involved in the fraud and the allegations were too vague. Plaintiffs have 30 days to file an amended complaint to allege more specific facts to support fraud-based claims.
March 2014: A class-action lawsuit was filed against HSNi, Martha Stewart Living, Emerils.com, and Emeril’s Homebase for allegedly misleadingly promoting EMERIL™ Knives and Knife Sets. Specifically, plaintiffs allege that the companies represented that the knives are manufactured in Solingen, Germany (which is “world famous for producing high-quality cutlery”) when, according to the complaint, the knives are manufactured in China. In addition, the complaint alleges that the companies misrepresented the quality of the knives because, among other things, they are not made of high quality materials and do not perform as promised.
